Commercial Contract Terms
The contract terms that apply to commercial window film projects.
Effective Date: September 18, 2026
These Commercial Contract Terms apply to commercial window film projects performed by Tint Solutions Inc. ("Tint Solutions").
Project-specific information - including the customer or business name, project location, scope of work, selected window film or materials, contract price, payment schedule, installation requirements, and other project details - will be identified in the customer's proposal, purchase order, work authorization, or other applicable project documents.
These Commercial Contract Terms supplement the project-specific agreement and Tint Solutions Inc.'s general Terms & Conditions.
1. Scope of Work
Tint Solutions will furnish and install, or furnish only when specifically stated, the window film, materials, and related services described in the customer's approved proposal.
Only work specifically identified in the proposal, approved purchase order, work authorization, or subsequently approved change order is included in the project.
Work not expressly included in the agreed scope may be treated as additional work and may result in additional charges.
2. Contract Price & Payment
The contract price and applicable payment terms will be stated in the customer's proposal or other project-specific agreement.
Unless otherwise agreed to in writing, the required deposit must be received before materials are ordered and the project is placed into the installation schedule.
Deposits may be applied toward material procurement, project preparation, scheduling, mobilization, and other project costs.
The remaining balance is due upon completion of the project unless alternative payment terms have been approved by Tint Solutions in writing.
Any undisputed balance remaining unpaid more than fifteen (15) days after becoming due may be subject to a late fee, finance charge, or interest at the maximum rate permitted by applicable law, accruing from the date the balance became past due until paid in full.
Tint Solutions may, at its sole discretion, waive or reduce any late fee, finance charge, or interest without waiving its right to enforce these payment terms on any other invoice, balance, or future project.
3. Deposits & Special-Order Materials
Window film and related materials may be ordered specifically for an individual project.
Once materials have been ordered, cut, fabricated, shipped, allocated, or otherwise committed to a project, associated material costs may be non-refundable to the extent permitted by applicable law and the project agreement.
Cancellation or postponement of a project does not necessarily relieve the customer of responsibility for materials, mobilization, completed work, or other costs already incurred by Tint Solutions.
Any applicable cancellation charges will reflect the circumstances of the project and costs reasonably incurred or committed.
4. Scheduling & Installation
Installation dates are scheduled based on material availability, project readiness, access, crew availability, coordination with other trades, and other project conditions.
Unless otherwise agreed, customers should allow for a 60-minute arrival window on scheduled installation days.
Tint Solutions may reasonably adjust installation dates because of material delays, site conditions, weather, access restrictions, changes in construction schedules, interference from other trades, customer-requested postponements, or circumstances outside Tint Solutions' reasonable control.
5. Project Access & Site Readiness
The customer, property owner, general contractor, property manager, or other responsible party shall provide Tint Solutions with timely and safe access to all areas necessary to perform the work.
Work areas should be reasonably clear and ready for installation before Tint Solutions arrives.
Unless otherwise included in the proposal, Tint Solutions is not responsible for moving heavy furniture, merchandise, machinery, displays, computers, artwork, fragile items, or other property obstructing access to the glass.
Delays caused by inaccessible or unprepared work areas may result in rescheduling, additional labor charges, mobilization charges, or trip charges.
6. Coordination With Other Trades
The customer or project representative is responsible for coordinating Tint Solutions' access with other contractors, tenants, occupants, security personnel, building management, and other trades when necessary.
Tint Solutions is not responsible for delays or additional costs caused by interference from other trades, incomplete preceding work, restricted building access, unavailable elevators or lifts, blocked work areas, or other project coordination issues outside Tint Solutions' control.
7. Existing Glass & Glazing Conditions
Window film is installed onto an existing glazing system that was manufactured, transported, installed, maintained, and exposed to environmental and structural conditions before Tint Solutions began work.
Tint Solutions uses reasonable professional care and applicable manufacturer film-to-glass compatibility guidance when evaluating and installing window film.
• Edge damage, chips, or scratches
• Manufacturing defects
• Nickel sulfide inclusions
• Internal or residual stresses
• Previous thermal stress
• Improper glass installation or glazing
• Damaged or deteriorated insulated-glass seals
• Building or frame movement
• Unknown coatings or surface treatments
• Concealed glass-edge damage
• Prior modifications or repairs
• Other pre-existing or concealed conditions
Glass may experience thermal stress, spontaneous breakage, cracking, insulated-glass seal failure, coating failure, or other glazing-related problems independently of Tint Solutions' workmanship.
To the fullest extent permitted by law, Tint Solutions is not responsible for glass breakage, seal failure, coating failure, cracking, or other glazing failure caused by pre-existing, concealed, manufacturing, structural, environmental, glazing-system, or other conditions outside Tint Solutions' reasonable control.
Nothing in this provision is intended to waive or limit responsibility that applicable law does not permit to be waived or limited.
8. Existing Window Film Installed by Others
When Tint Solutions is asked to remove, replace, work over, work adjacent to, or otherwise perform services involving window film previously installed by another company or individual, Tint Solutions cannot verify the prior film's:
• Manufacturer or product type
• Age or condition
• Adhesive system
• Solar absorption characteristics
• Film-to-glass compatibility
• Original installation method
• Previous thermal effects on the glass
• Quality of installation
• Removal history
• Condition of the glass before the previous installation
Existing film or adhesive may conceal scratches, chips, cracks, coating damage, seal deterioration, edge damage, or other conditions that become visible only during or after removal.
Tint Solutions will exercise reasonable professional care during removal.
To the fullest extent permitted by law, Tint Solutions is not responsible for glass breakage, scratching, coating failure, seal failure, cracking, or other damage resulting from pre-existing conditions, concealed conditions, prior installations, prior film or adhesive, previous workmanship, or conditions not caused by Tint Solutions' failure to exercise reasonable care.
9. Film-to-Glass Compatibility
Tint Solutions evaluates proposed film applications using information reasonably available concerning the glazing system, applicable manufacturer specifications, film-to-glass compatibility guidance, and professional experience.
Film-to-glass compatibility guidance is intended to reduce risk but cannot eliminate every possibility of thermal stress, spontaneous glass breakage, seal failure, or other glazing-related problems.
Tint Solutions reserves the right to decline or modify a requested film application if Tint Solutions reasonably determines that the selected film may be inappropriate for the existing glass or glazing system.
10. Pre-Existing Scratches, Damage & Defects
Window film may make existing scratches, chips, stains, hard-water deposits, fabrication debris, glass distortion, coating defects, or other imperfections more noticeable.
Tint Solutions is not responsible for damage, defects, imperfections, or deterioration that existed before Tint Solutions began work.
Nothing in this section excludes responsibility for damage directly caused by Tint Solutions' failure to exercise reasonable care.
11. Window Film Appearance & Curing
Window film is generally installed using a wet application process.
Immediately following installation, temporary haze, cloudiness, moisture pockets, water bubbles, visual distortion, or other moisture-related curing conditions may be visible.
These conditions do not necessarily indicate an installation defect and typically diminish as installation moisture evaporates and the film cures.
Curing time varies depending on film type, glass construction, temperature, sunlight exposure, humidity, season, and other environmental conditions.
The customer agrees to allow a reasonable curing period before evaluating the final appearance of the installation.
12. Safety & Security Window Film
Safety and security films are designed to increase glass retention and resistance to certain impacts when installed as part of an appropriate glazing system.
No window film, attachment system, or glazing treatment makes glass unbreakable or guarantees prevention of forced entry, burglary, intrusion, injury, property damage, blast damage, storm damage, or other loss.
Performance depends on glass construction, framing system, film specification, attachment system, installation configuration, impact conditions, and surrounding structural conditions.
Any representation regarding safety or security performance is limited to applicable manufacturer specifications and testing for the specific system installed.
13. Exterior Window Film
Exterior-applied films are exposed directly to sunlight, weather, moisture, airborne contaminants, landscaping, sprinklers, salt air, cleaning activities, and other environmental conditions.
Exterior films may therefore have different service lives, appearance characteristics, maintenance requirements, and warranty periods than interior-applied films.
Applicable manufacturer warranty terms control manufacturer-provided product coverage.
14. Lifts, Scaffolding & Special Access Equipment
When lifts, scaffolding, swing stages, specialty ladders, traffic control, fall-protection systems, or other special access equipment are required, responsibility and pricing for such equipment will be identified in the proposal or otherwise agreed upon.
Additional equipment or access requirements discovered after the proposal may constitute additional work.
The customer is responsible for ensuring that areas where customer-provided access equipment will be used are reasonably suitable and available for the intended work.
15. Electrical, Mechanical & Building Components
Unless specifically included in the proposal, Tint Solutions is not responsible for disconnecting, relocating, modifying, or repairing electrical wiring, alarm systems, window sensors, HVAC equipment, blinds, shades, signage, security systems, mechanical equipment, or other building components.
If such work becomes necessary, it may require coordination with an appropriately qualified trade and may affect project pricing or scheduling.
16. Performance of Work & Subcontractors
Tint Solutions may perform work through its owner/operator and may engage appropriately licensed or otherwise legally qualified subcontractors when appropriate for the project.
The use of subcontractors does not alter Tint Solutions' contractual obligations to the customer.
Subcontractors remain responsible for maintaining licenses, insurance, or other qualifications required of them by applicable law.
17. Changes & Additional Work
Changes to the project scope, film specification, quantities, access requirements, installation conditions, schedule, or other project requirements may result in additional charges or credits.
Material changes will be documented through a written change order, revised proposal, written authorization, or other mutually accepted written documentation as appropriate.
Additional work will not be considered included merely because it is located within or adjacent to the original project area.
18. Measurements & Final Quantities
Proposal quantities may be based on field measurements, plans, drawings, schedules, customer-provided information, or estimated quantities.
If actual site conditions or final field measurements materially differ from the information used to prepare the proposal, Tint Solutions may revise quantities and pricing before performing affected additional work.
Customer-provided measurements, drawings, specifications, or quantities remain the responsibility of the party providing them unless Tint Solutions specifically agrees in writing to verify them.
19. Warranty Coverage
Applicable manufacturer warranties are governed by the manufacturer's written warranty terms, limitations, exclusions, eligibility requirements, and claim procedures.
Tint Solutions' workmanship obligations apply to installation workmanship performed by or on behalf of Tint Solutions.
Warranty coverage becomes active following completion of the project and payment of the final invoice to the extent permitted by applicable law and applicable manufacturer warranty requirements.
A manufacturer warranty claim does not eliminate the customer's responsibility to pay undisputed amounts properly due for completed work.
20. Cleaning & Maintenance
Customers and building personnel should follow cleaning and maintenance instructions provided by Tint Solutions and/or the film manufacturer.
Damage resulting from improper cleaning methods, abrasive materials, blades, scrapers, incompatible chemicals, pressure washing, unauthorized modifications, third-party work, or other improper maintenance is not considered an installation defect.
21. Unforeseen Conditions
Concealed, unknown, or not reasonably discoverable conditions may require modification of the planned installation.
If such a condition materially affects the work, Tint Solutions will communicate the condition to the customer or authorized project representative and, when necessary, obtain authorization for additional or modified work.
22. Delays Outside Tint Solutions' Control
Tint Solutions is not responsible for reasonable delays caused by circumstances outside its control, including severe weather, material shortages, manufacturer or shipping delays, inaccessible work areas, construction delays, building conditions, glazing conditions, customer-requested postponements, other trades, emergencies, acts of government, or other circumstances Tint Solutions could not reasonably prevent.
Tint Solutions will make reasonable efforts to communicate material scheduling changes.
23. Project Suspension
Tint Solutions may temporarily suspend work if the project site becomes unsafe, required access is unavailable, scheduled payments are materially past due, necessary approvals have not been obtained, another trade prevents installation, or conditions arise that make continued work unreasonable or unsafe.
Work may resume after the condition causing the suspension has been reasonably resolved.
Reasonable costs resulting from customer-caused suspension, remobilization, or repeated access problems may be treated as additional project costs.
24. Completion & Acceptance
The project will be considered substantially complete when the contracted window film work has been installed or otherwise completed, except for minor corrective or punch-list items that do not materially prevent the intended use of the installation.
Minor punch-list or warranty items do not automatically justify withholding payment for undisputed completed work.
The customer or authorized project representative should notify Tint Solutions within a reasonable period of any installation concern so Tint Solutions has an opportunity to inspect and, when appropriate, correct the issue.
25. Project Photography
Tint Solutions may photograph or record completed or in-progress work for documentation, quality control, warranty records, portfolio use, and marketing.
Tint Solutions will make reasonable efforts to avoid unnecessarily displaying confidential or customer-identifying information.
Customers who do not want project photographs used for portfolio or marketing purposes may notify Tint Solutions in writing before installation.
26. Insurance, Licensing & Bonding
Tint Solutions Inc. maintains applicable contractor licensing and bonding requirements for work performed where such licensing or bonding is required.
Tint Solutions carries commercial general liability insurance.
Certificates of Insurance and requests for additional insured status, waivers, endorsements, project-specific insurance requirements, or special coverage may be accommodated when available and agreed upon. Additional costs associated with special insurance requirements may be charged to the customer or project.
27. Permits, Building Requirements & Approvals
Unless specifically included in the proposal, the customer or responsible project representative is responsible for identifying building-specific rules, landlord requirements, HOA requirements, security procedures, union requirements, restricted work hours, loading requirements, parking restrictions, and similar site requirements before work begins.
If permits, engineering, special inspections, testing, or additional approvals become necessary, responsibility for obtaining and paying for them will be established before the affected work proceeds.
28. Governing Project Documents
The project-specific proposal, approved change orders, purchase orders accepted by Tint Solutions, these Commercial Contract Terms, and Tint Solutions' general Terms & Conditions collectively form the applicable project agreement to the extent incorporated or accepted by the parties.
If a customer purchase order contains terms that conflict with Tint Solutions' proposal or contract terms, acceptance of the purchase order does not automatically constitute acceptance of conflicting or additional terms unless Tint Solutions expressly agrees to them in writing.
29. General Terms & Conditions
Tint Solutions Inc.'s general Terms & Conditions also apply to projects as incorporated into the applicable project agreement.
They are available at: tintsolutionsinc.com/terms If these Commercial Contract Terms conflict with an express project-specific provision mutually agreed to in writing, the expressly agreed project-specific provision will control for that project.
Nothing in these Commercial Contract Terms is intended to waive rights, remedies, responsibilities, or liabilities that applicable law does not permit to be waived.
