California Residential Contract Terms

The contract terms that apply to residential window film projects.

Effective Date: September 18, 2026

These California Residential Contract Terms apply to residential window film projects performed by Tint Solutions Inc. in the State of California.

Project-specific information - including the customer's name and project address, scope of work, selected window film or materials, contract price, payment schedule, approximate start and completion dates, and other project details - will be identified in the customer's proposal and applicable Home Improvement Contract.

These Residential Contract Terms supplement the project-specific agreement and Tint Solutions Inc.'s general Terms & Conditions.

1. Scope of Work

Tint Solutions Inc. ("Tint Solutions") will furnish and install, or furnish only when specifically stated, the window film, materials, and related services described in the customer's approved proposal.

Only work specifically identified in the proposal, Home Improvement Contract, or subsequently approved written change order is included in the project.

Any additional work requested by the customer may require additional charges and a written change order.

2. Contract Price & Payment

The total contract price and applicable payment schedule will be stated in the customer's project-specific Home Improvement Contract and/or incorporated proposal.

For California residential home improvement projects subject to statutory down-payment limitations, Tint Solutions will not request or accept a down payment exceeding the amount permitted by applicable California law.

The remaining project balance and any applicable progress payments shall be due according to the payment schedule contained in the project-specific agreement.

Any undisputed balance remaining unpaid more than fifteen (15) days after becoming due may be subject to a late fee, finance charge, or interest at the maximum rate permitted by applicable law.

Tint Solutions may, at its sole discretion, waive or reduce any such charge without waiving its right to enforce applicable payment terms on another invoice, balance, or future project.

3. Scheduling & Project Dates

Approximate start and completion dates will be identified in the customer's project-specific Home Improvement Contract.

Installation dates are subject to material availability, site readiness, customer access, weather, scheduling conditions, approved change orders, manufacturer or shipping delays, and other circumstances reasonably outside Tint Solutions' control.

On scheduled installation days, customers should allow for a 60-minute arrival window unless otherwise stated.

4. Customer Responsibilities & Work Area

The customer is responsible for providing reasonable and safe access to all areas where work will be performed.

Whenever reasonably possible, approximately three (3) feet of clear working space should be provided in front of windows scheduled for installation.

Customers should remove valuables, fragile items, sensitive equipment, furniture, decorations, and other objects that may interfere with the installation.

Children, pets, occupants, and unnecessary foot traffic should remain outside the immediate installation area while work is being performed.

The customer is responsible for informing Tint Solutions of any known unusual or concealed conditions that may affect the work, including existing glass damage, specialty coatings, window sensors, wiring, alarm components, prior window film, glazing problems, or other relevant conditions.

5. Existing Glass & Glazing Conditions

Window film is installed onto an existing glazing system that was manufactured, transported, installed, maintained, and exposed to environmental and structural conditions before Tint Solutions began work.

Tint Solutions uses reasonable professional care and applicable manufacturer film-to-glass compatibility guidance when evaluating and installing window film.

• Edge damage, chips, or scratches

• Manufacturing defects

• Nickel sulfide inclusions

• Internal or residual stresses

• Previous thermal stress

• Improper glass installation or glazing

• Damaged or deteriorated insulated-glass seals

• Building or frame movement

• Unknown coatings or surface treatments

• Concealed glass-edge damage

• Prior modifications or repairs

• Other pre-existing or concealed conditions

Glass may experience thermal stress, spontaneous breakage, cracking, insulated-glass seal failure, coating failure, or other glazing-related problems independently of Tint Solutions' workmanship.

To the fullest extent permitted by law, Tint Solutions is not responsible for glass breakage, seal failure, coating failure, cracking, or other glazing failure caused by pre-existing, concealed, manufacturing, structural, environmental, glazing-system, or other conditions outside Tint Solutions' reasonable control.

Nothing in this provision is intended to waive or limit responsibility that applicable law does not permit to be waived or limited.

6. Existing Window Film Installed by Others

When Tint Solutions is asked to remove, replace, work over, work adjacent to, or otherwise perform services involving window film previously installed by another company or individual, Tint Solutions cannot verify the prior film's:

• Manufacturer or product type

• Age or condition

• Adhesive system

• Solar absorption characteristics

• Film-to-glass compatibility

• Original installation method

• Previous thermal effects on the glass

• Quality of installation

• Removal history

• Condition of the glass before the previous installation

Existing film or adhesive may conceal scratches, chips, cracks, coating damage, seal deterioration, edge damage, or other conditions that become visible only during or after removal.

The customer acknowledges that removal of existing film and adhesive may reveal pre-existing or concealed glass conditions.

Tint Solutions will exercise reasonable professional care when removing existing film and adhesive.

To the fullest extent permitted by law, Tint Solutions is not responsible for glass breakage, scratching, coating failure, seal failure, cracking, or other damage resulting from pre-existing conditions, concealed conditions, prior installations, prior film or adhesive, previous workmanship, or conditions not caused by Tint Solutions' failure to exercise reasonable care.

7. Film-to-Glass Compatibility

Tint Solutions evaluates proposed film applications using information reasonably available concerning the glazing system, applicable manufacturer specifications, film-to-glass compatibility guidance, and professional experience.

Film-to-glass compatibility guidance is intended to reduce risk but cannot eliminate every possibility of thermal stress, spontaneous glass breakage, seal failure, or other glazing-related problems.

Tint Solutions reserves the right to decline or modify a requested film application if Tint Solutions reasonably determines that the selected film may be inappropriate for the existing glass or glazing system.

8. Pre-Existing Scratches, Damage & Defects

Window film may make existing scratches, chips, stains, hard-water deposits, fabrication debris, glass distortion, coating defects, or other imperfections more noticeable.

Tint Solutions is not responsible for damage, defects, imperfections, or deterioration that existed before Tint Solutions began work.

Nothing in this section excludes responsibility for damage directly caused by Tint Solutions' failure to exercise reasonable care.

9. Window Film Appearance & Curing

Window film is generally installed using a wet application process.

• Haze or cloudiness

• Moisture pockets

• Water bubbles

• Temporary visual distortion

• Other moisture-related curing conditions

These conditions do not necessarily indicate an installation defect and typically diminish as installation moisture evaporates and the film cures.

Curing time varies depending on film type, glass construction, temperature, sunlight exposure, humidity, season, and other environmental conditions.

Customers should allow the film a reasonable curing period before evaluating its final appearance.

10. Safety & Security Window Film

Safety and security films are designed to increase glass retention and resistance to certain impacts when installed as part of an appropriate glazing system.

No window film, attachment system, or glazing treatment makes glass unbreakable or guarantees prevention of forced entry, burglary, intrusion, injury, property damage, blast damage, storm damage, or other loss.

Actual performance depends on numerous factors, including glass construction, framing system, film specification, attachment system, installation configuration, impact conditions, and the surrounding structure.

Any representation regarding safety or security performance is limited to the applicable manufacturer specifications and testing for the specific system installed.

11. Exterior Window Film

Exterior-applied window film is exposed directly to sunlight, weather, moisture, airborne contaminants, landscaping, sprinklers, salt air, cleaning activities, and other environmental conditions.

Exterior films may therefore have different expected service lives, appearance characteristics, maintenance requirements, and warranty periods than interior-applied films.

Applicable manufacturer warranty terms control manufacturer-provided product coverage.

12. Performance of Work & Subcontractors

Tint Solutions may perform work through its owner/operator and may engage appropriately licensed or otherwise legally qualified subcontractors when appropriate for a project.

The use of subcontractors does not alter Tint Solutions' contractual obligations to the customer.

Tint Solutions will provide information concerning subcontractors when required by applicable California law.

13. Changes & Additional Work

Any material change to the scope of work, materials, contract price, payment schedule, or project completion date will be documented through a written change order when required by applicable law.

• Additional, deleted, or modified work

• Changes to materials or film specifications

• Amounts added to or deducted from the contract price

• Changes to progress payments

• Changes to the anticipated project schedule

Required change orders must be approved before the changed work begins except where otherwise permitted by law.

14. Warranty Coverage

Applicable manufacturer warranties are governed by the manufacturer's written warranty terms, limitations, exclusions, eligibility requirements, and claim procedures.

Tint Solutions' workmanship obligations apply to installation workmanship performed by or on behalf of Tint Solutions.

Warranty coverage becomes active following completion of the project and payment of the final invoice to the extent permitted by applicable law and applicable manufacturer warranty requirements.

A manufacturer warranty claim does not eliminate the customer's responsibility to pay undisputed amounts properly due for completed work.

15. Cleaning & Maintenance

Customers should follow all cleaning and maintenance instructions provided by Tint Solutions and/or the film manufacturer.

Damage resulting from improper cleaning methods, abrasive materials, blades, scrapers, incompatible chemicals, pressure washing, unauthorized modifications, third-party work, or other improper maintenance is not considered an installation defect.

16. Unforeseen Conditions

Conditions that were concealed, unknown, or not reasonably discoverable before work began may require modification of the planned installation.

If such a condition materially affects the work, Tint Solutions will communicate the condition to the customer and, when necessary, obtain authorization for additional or modified work before proceeding.

17. Delays Outside Tint Solutions' Control

Tint Solutions is not responsible for reasonable delays caused by circumstances outside its control, including severe weather, material shortages, manufacturer delays, shipping delays, inaccessible work areas, building conditions, glazing conditions, customer-requested postponements, emergencies, acts of government, or other circumstances Tint Solutions could not reasonably prevent.

Tint Solutions will make reasonable efforts to communicate material scheduling changes to the customer.

18. Project Photography

Tint Solutions may photograph or record completed or in-progress work for documentation, quality control, warranty records, portfolio use, and marketing.

Tint Solutions will make reasonable efforts to avoid unnecessarily displaying customer-identifying information.

Customers who do not want project photographs used for portfolio or marketing purposes may notify Tint Solutions in writing before installation.

19. Insurance & Contractor Licensing

Tint Solutions Inc. is a California licensed contractor and maintains applicable contractor licensing and bonding requirements.

Tint Solutions carries commercial general liability insurance.

Tint Solutions currently operates without employees and maintains its workers' compensation status in accordance with applicable California licensing and insurance requirements.

Project-specific Home Improvement Contracts will contain applicable California insurance and contractor disclosures required by law.

20. California Home Improvement Contract

These Residential Contract Terms do not replace the customer's project-specific California Home Improvement Contract.

For projects subject to California home improvement contracting requirements, the customer will receive the applicable project-specific contract containing required information and disclosures, including as applicable:

• Contractor and customer information

• Project address

• Detailed description of work and materials

• Total contract price

• Down payment and payment schedule

• Approximate start and completion dates

• Change-order requirements

• Insurance disclosures

• Mechanics lien information

• Contractors State License Board information

• Applicable cancellation notices and rights

• Other disclosures required by California law

The customer's project-specific Home Improvement Contract controls where these Residential Contract Terms conflict with a mandatory provision of California law or an express project-specific contract provision.

21. General Terms & Conditions

Tint Solutions Inc.'s general Terms & Conditions also apply to projects as incorporated into the customer's agreement.

Customers are encouraged to contact Tint Solutions before approving a proposal or contract with any questions concerning film selection, glass compatibility, pricing, scheduling, installation, warranty coverage, or these Residential Contract Terms.
